3070 - CCLR 59(a) 
 

In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58,

Observation: Through the investigation process, Licensing determined that no documentation was kept at the facility related to minor incidents, illness and unexpected events.

Corrective action: Ensure records referred to in sections 56 to 58, are kept in a single place at the community care facility. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On May 19, 2022, Licensee submitted a corrective action plan to Licensing. This corrective action plan included log books would be kept at the facility and in the event a parent requested a copy, the facility would have a separate book. This corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan.

3070 - CCALA 7(1)(b)(i) 
 

A licensee must do all of the following:(b) operate the community care facility in a manner that will promote the health, safety and dignity of persons in care

Observation: Through the investigation process, Licensing determined that “time out” was used as a behavioural strategy which is not an accepted method by Licensing.

Corrective action: Ensure the community care facility is operated in a manner that will promote the health, safety and dignity of persons in care, specifically regarding behaviour guidance policy containing practices that are appropriate. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to this contravention. Action/s Required by Licensing: On May 19, 2022, Licensee submitted a corrective action plan to Licensing. This corrective action plan included: time out would no longer be used at the facility and this was reflected in the facilities policies. This corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan.

3070 - CCLR 56(1)(f) 
 

A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.

Observation: Through the investigation process, Licensing determined that no evidence was provided indicating that a log of minor accidents, illnesses and unexpected events involving children that did not require medical attention and were not reportable incidents described in Schedule H were kept. Two staff stated no log book was kept of minor incidents or communication. During Routine Inspection 504862e9-ba3e-49c6-86aa-8747a8e8d9bf, dated January 24, 2022 Licensing reviewed documentation practices with Licensee. Licensee and staff stated notes were kept with the daily attendance records. Licensing did not observe documentation of regular communication/minor incident logs.

Corrective action: Ensure current records of a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H are kept. 3070 - CCLR 55(2)(a) 
 

A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee,

Observation: Through the investigation process, Licensing determined that no incident report was submitted to Licensing for the child who had been involved in a reportable incident as described in Schedule H.

Corrective action: Ensure a medical health officer is notified within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On May 19, 2022, Licensee submitted a corrective action plan to Licensing. This corrective action plan included the Licensee would inform Licensing immediately in the form of an incident report, specifically related to missing and wandering. This corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan.

3070 - CCLR 57(2)(g) 
 

A licensee must keep, for each child, a record showing the following information: (g) any notification of a parent, emergency contact or medical health officer made under section 55 [notification of illness or injury]

Observation: Through the investigation process, Licensing determined that there was no documentation related to notification of a parent regarding reportable incidents.

Corrective action: Ensure for each child, a record showing the following information: (g) any notification of a parent, emergency contact or medical health officer made under section 55 [notification of illness or injury]. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On May 19, 2022 Licensee submitted a corrective action plan to Licensing. This corrective action plan included log books would be kept at the facility. This corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan.

3030 - CCLR 39(1) 
 

A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.

Observation: Through the investigation process, Licensing determined that a child in care had been missing and was unsupervised.

Corrective action: Ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult. Subsection (2) (a) does not apply to a licensee who provides care to fewer than the number of children permitted in a group under Schedule E. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On May 19, 2022 Licensee submitted a corrective action plan to Licensing. This corrective action plan included staff would be engaged at all times in continuous supervision, which included a constant headcount and children would not be left unattended in any way. This corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan.
