A licensee must do all of the following:(b) operate the community care facility in a manner that will promote the health, safety and dignity of persons in care
Observation: Through the investigation process, Licensing determined that the staff had not ensured a heathy and safe environment when using a portable toilet.
Corrective action: Ensure the community care facility is operated in a manner that will promote the health, safety and dignity of persons in care. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to this contravention. Action/s Required by Licensing: On July 4, 9 and 14, 2023 Licensee submitted a corrective action plan to Licensing. The corrective action plan indicated that the outdoor toilet would be removed and not accessible or available for use. The corrective action plan was reviewed and accepted by Licensing. On October 13, 2023 Licensing conducted a Routine inspection and confirmed that the outdoor portable toilet had been removed.

Observation: Through the investigation process, Licensing determined that the facility was not following their transportation policies, specifically by sending children to gymnastics class with an Early Childhood Educator Assistant.
Corrective action: Ensure a community care facility operates in a manner that will promote the health, safety and dignity of persons in care. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On July 4, 9, and 14, 2023, Licensee submitted a corrective action plan to Licensing. This corrective action plan indicated that the Licensee and Early Childhood Educator would always drive the vehicle transporting the children. This corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. On October 13, 2023 Licensing conducted a Routine inspection and confirmed that Early Childhood Educator and Licensee was driving children to gymnastics.
Without limiting subsection (1), a licensee must ensure that the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Through the investigation process, Licensing determined that staff to child ratios were not maintained at all times when an Early Childhood Educator Assistant was left alone supervising children in care, or was transporting children alone in her vehicle.
Corrective action: Ensure that the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On December July 4, 9, and 14, 2023 Licensee submitted a corrective action plan to Licensing. The corrective action plan indicated that the Licensee had verified that one Early Childhood Educator (ECE) would work at the facility and would be covered by an Early Childhood Educator Assistant (ECEA) only if absent due to illness, emergency vacation, or other temporary leave up to 30 days. The corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. On October 13, 2023 Licensing conducted a Routine Inspection and confirmed and Early Childhood Educator Assistant was working at at the facility and covering for an Early Childhood Educator that had ended employment two weeks prior.
A licensee must operate the community care facility in a manner that will promote the health, safety and dignity of person in care
Observation: Through the investigation process, Licensing determined that the facility had exceeded the maximum capacity of children in care.
Corrective action: Ensure the community care facility is operated in a manner that will promote the health, safety and dignity of persons in care. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to this contravention. Action/s Required by Licensing: On July 4, 9 and 14, 2023 Licensee submitted a corrective action plan to Licensing. The corrective action plan indicated that the Licensee had conducted a review to the Child Care Licensing Regulation specific to the category of care and would ensure only eight children attend the facility at any time. The corrective action plan was reviewed and accepted by Licensing. On October 13, 2023 Licensing conducted a Routine Inspection and confirmed a maximum of eight children listed on attendance records audited from October 1, 2023.
A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure
Observation: Through the investigation process, Licensing determined that attendance records for children in care did not contain identification showing for each day whether a child is absent or present.
Corrective action: Ensure a daily attendance record is kept, for each child, showing for each day whether the child is absent or, if the child is present, the time of arrival and departure. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to this contravention. Action/s Required by Licensing: On July 4, 6, 14, 2018, Licensee submitted a corrective action plan to Licensing. The corrective action plan indicated that daily attendance records would be kept showing if a child was present or absent and time of arrival and departure. The corrective action plan was reviewed and accepted by Licensing. On October 13, 2023 Licensing conducted a Routine Inspection and confirmed attendance records for children in care were complete.
