3070 - CCLR 55(2)(a) 
 

A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee,

Observation: Through the investigation process, Licensing determined that reportable incidents were not reported to the Medical Health Officer within 24 hours. Specifically, the Licensee was aware of concerns related to staff utilizing physical restraint and/or a child being subjected to physical abuse and had not reported these concerns to the Medical Health Officer.

Corrective action: Ensure that the medical health officer is notified within 24 hours after a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee. Action/s Required by Licensee: Licensee to submit corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On January 12, 2023, Licensee submitted a corrective action plan specific to the contravention. The corrective action plan included staff review and sign off of facility policies, including reportable incidents, and reportable incidents would be reported to Licensing within 24 hours. This corrective action plan has been reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. On January 24, 2023, Licensing received documentation which indicated that staff reviewed facility policies.

3030 - CCALA 7(1)(b)(i) 
 

A licensee must operate the community care facility in a manner that will promote the health, safety and dignity of person in care

Observation: Through the investigation process, Licensing determined that the facility was not operated in a manner that promoted the health, safety and dignity of children in care. Specifically, staff not promoting the dignity of a child when toileting.

Corrective action: Ensure that a Licensee operates the community care facility in a manner that will promote the health, safety and dignity of persons in care. Action/s Required by Licensee: Licensee to submit a corrective action plan specific to this contravention. Action/s Required by Licensing: On January 12, 2023, Licensee submitted a corrective action plan specific to the contravention. The corrective action plan included staff review and sign off of the child's washroom care plan, provide the child privacy when toileting if requested and staff would privately and quietly speak with the child related to toileting. This corrective action plan has been reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. On January 24, 2023, Licensing received documentation which indicated that staff reviewed the child's washroom care plan.

3030 - CCLR 52(1)(b) 
 

A licensee must ensure that a child, while under the care or supervision of the licensee, is not subjected to confinement or physical restraint by an employee, except as authorized in a child care plan if the plan includes instructions respecting behavioural guidance.

Observation: Through the investigation process, Licensing determined that children in care were subject to physical restraint by an employee. Specifically, children in care were being held by staff members with the intent of not allowing them to move.

Corrective action: Ensure that a child is not, while under the care or supervision of the licensee, subjected to confinement or physical restraint by an employee. Action/s Required by Licensee: Licensee to submit a corrective action plan specific to this contravention. Action's Required by Licensing: On January 12, 2023, Licensee submitted a corrective action plan specific to the contravention. The corrective action plan included the facility's Use of Restraint policy was updated, all staff review and sign off of facility policies, and staff involved in this contravention received additional education of these policies. This corrective action plan has been reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. On January 24, 2023, Licensing received documentation which indicated that the Use of Restraint policy was updated and staff received education and reviewed facility policies.
