Category/Description

A licensee must do all of the following: operate the community care facility in a manner that will promote in the case of adult persons in care, the rights of those persons in care;

Observation: Through the investigation process, Licensing determined that the rights of persons in care were not promoted. Specifically, in respect to the right for an adult person in care to have his or her lifestyle and choices respected and supported.

Corrective action: Ensure to operate the community care facility in a manner in the case of adult persons in care, that would promote the rights of those persons in care. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On March 28, 2022 and August 19, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included for two staff education on the rights of persons in care. The corrective action plan was reviewed and accepted by Licensing. On March 28, 2022 and August 19, 2022, Licensing received documentation that demonstrated the education was provided.

A licensee must operate the community care facility in a manner that will promote the health, safety and dignity of persons in care

Observation: Through the investigation process, Licensing determined that the facility was not operated in a manner to promote the health, safety and dignity of persons in care. Specifically, in respect to staff character and skills.

Corrective action: Ensure to operate the community care facility in a manner that will promote the health, safety and dignity of persons in care. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On March 28, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included an education day for one staff, on the following topics related to abuse, rights of persons in care, boundaries, communication and behaviours; A staff meeting to review of policies on abuse, behaviours and care planning; training on for Residential Care Aides, support services staff, recreation staff and Licensed Practical Nurses on incident reporting and abuse. The corrective action plan was reviewed and accepted by Licensing. On March 28, 2022, Licensing received documentation that demonstrated the meetings and training were completed.

A licensee must ensure that a person in care is not, while under the care or supervision of the licensee subjected to any of the following types of abuse or neglect, as described in section 1 of Schedule D: emotional abuse

Observation: Through the investigation process, Licensing determined that a person in care, while under the care or supervision of the licensee, was subjected to emotional abuse.

Corrective action: Ensure that a person in care was not, while under the care or supervision of the licensee subjected to any of the following types of abuse or neglect, as described in section 1 of Schedule D: emotional abuse. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On March 28, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included for one staff, education on a variety of topics related to abuse, rights of persons in care, boundaries, communication and behaviours. The corrective action plan was reviewed and accepted by Licensing. On March 28, 2022, Licensing received documentation that demonstrated the education was provided.

A licensee must ensure that each care plan is reviewed and, if necessary, modified if there is no substantial change in the circumstances of the person in care, at least once each year to ensure it continues to meet the needs and preferences, and is compatible with the abilities, of the person in care who is the subject of the care plan

Observation: Through the investigation process, Licensing determined that the care plan for a person in care was not modified due to a substantial change in the circumstances of the person in care.

Corrective action: Ensure that each care plan was reviewed and, if necessary, modified if there was no substantial change in the circumstances of the person in care, at least once each year to ensure it continued to meet the needs and preferences, and was compatible with the abilities, of the person in care who was the subject of the care plan. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On March 28, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included the care plan for a person in care would be revised. The corrective action plan was reviewed and accepted by Licensing. On March 28, 2022, Licensing received the updated care plan.
