3070 - RCR 81(3)(a)(ii) 
 

A care plan must include all of the following: a plan to address behavioural intervention, if applicable

Observation: Through the investigation process, Licensing determined that a care plan for a person in care had not included behaviours related to night terrors.

Corrective action: Ensure that if a person in care has behaviours, that the care plan includes behavioural interventions. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On July 20, 2022, Manager submitted a corrective action plan to Licensing. The corrective action plan included, a care and behaviour support plan for a person in care was updated and submitted to Licensing on August 23, 2022. The corrective action plan was reviewed and accepted by Licensing.

A licensee must ensure that the implementation of each care plan is monitored on a regular basis to ensure proper implementation,

Observation: Through the investigation process, Licensing determined that the implementation of a person in care's care plan was not monitored on a regular basis to ensure proper implementation.

Corrective action: Ensure that the implementation of each care plan is monitored on a regular basis to ensure proper implementation. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On July 20, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included, a care and behaviour support plan for a person in care was updated and submitted to Licensing on August 23, 2022. The corrective action plan was reviewed and accepted by Licensing.

3030 - RCR 52(1)(a)(i) 
 

A licensee must ensure that a person in care is not, while under the care or supervision of the licensee subjected to any of the following types of abuse or neglect, as described in section 1 of Schedule D: emotional abuse

Observation: Through the investigation process, Licensing determined that the Licensee did not ensure that a person in care is not, while under the care or supervision of the Licensee, subjected to emotional abuse.

Corrective action: Ensure that a person in care is not, while under the care or supervision of the licensee, subjected to emotional abuse. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On July 20, 2022, Licensee submitted a corrective action plan to Licensing. This corrective action plan included, a staff meeting was held on June 13, 2022 which included education provided to staff about the Code of Ethics and were reminded to use a calm, low tone and voice with persons in care and two staff received verbal warning related to their demeanor towards persons in care. The corrective action plan was reviewed and accepted by Licensing. On September 12, 2022, the Licensee confirmed that they had spoken to the staff on September 9, 2022.

A licensee must ensure that food or fluids are not used as a form of reward to persons in care.

Observation: Through the investigation process, Licensing determined staff had used food as a reward with persons in care.

Corrective action: Ensure that food or fluids are not used as a form of reward to persons in care. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On July 20, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included a staff meeting was held on June 13, 2022 with education provided to staff about the Residential Care Regulation related to food and nutrition, the rights of persons in care related to food choices, and two staff received verbal warnings related to their demeanor towards persons in care. This corrective action plan was reviewed and accepted by Licensing.

3000 - CCALA 7(1)(b)(i) 
 

A licensee must operate the community care facility in a manner that will promote the health, safety and dignity of persons in care

Observation: Through the investigation process, Licensing determined that staff did not demonstrate the skills and abilities necessary to carry out the duties assigned. Specifically, staff used food as a reward and loud voices as a form of behaviour intervention.

Corrective action: Ensure to operate the facility in a manner that will promote the health, safety and dignity of persons in care. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On July 20, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included a staff meeting was held on on June 13, 2022 with the following education provided to staff: staff were retrained on the Residential Care Regulation, related to food and nutrition and the Code of Ethics was discussed with staff and they were reminded to use a calm, low tone and voice with persons in care. The corrective action plan was reviewed and accepted by Licensing.

3080 - CCALA 7(1)(b)(ii) 
 

A licensee must operate the community care facility in a manner that will promote in the case of adult persons in care, the rights of those persons in care

Observation: Through the investigation process, Licensing determined that the rights of persons in care was not promoted.

Corrective action: Ensure to operate the facility in a manner that will promote in the case of adult persons in care, the rights of those persons in care. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On July 20, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included a staff meeting was conducted on June 13, 2022 with education and discussion of the Bill of Rights. The corrective action plan was reviewed and accepted by Licensing.
