3070 - CCLR 51(1) 
 

A licensee must (a) ensure that behavioural guidance is appropriate to the age and development of the child who is receiving the guidance, and (b) provide to employees and parents a written statement of the licensee's policy on behavioural guidance.

Observation: Through the investigation process, by admission a staff stated she had picked up and removed a child from the room because the child would not apologize to a child after hurting that child in a wrestling activity. A second staff observed the incident and admitted the staff did pick up the child and remove the child from the classroom.

Corrective action: Ensure that behavioral guidance is appropriate to the age and development of the child in care. Action/s Required by Licensee: Licensee to submit a corrective action plan specific to this contravention. Action/s Required by Licensing: On January 26, 2022, Licensee submitted a corrective action plan specific to the contravention. The corrective action plan included all staff receiving a copy of the facility's Behavioral Guidance policies and procedures by email. A staff meeting was held on January 24 and January 26, 2022. All center policies and procedures were reviewed. A signed copy stating staff had read and would follow the policies had been placed in each employee's file. Children were not required to verbally apologize if they did not want to. This had been added to the guidance policy. Under no circumstances would Castle Care staff physically remove a child from any situation. This corrective action plan has been reviewed and accepted by Licensing.

3020 - CCLR 56(2) 
 

A licensee must ensure that the policies and procedures referred to in subsection (1) are implemented by employees.

Observation: Through the investigation process, Licensing determined that the Behavioural Guidance policy was not followed by a staff.

Corrective action: Ensure policies including the Behavioral Guidance policy are implemented. Action/s required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On January 26, 2022, the Licensee submitted a corrective action plan specific to the contravention. The corrective action plan included the Behavioural Guidance policy was updated; children were not required to verbally apologize, staff were to bring their concerns regarding challenging behaviour to the manager, the staff and manager would generate ideas how to make the child's day successful. If the child was unable to safely join the program after staff had tried the above strategies the parents/caregivers would be phoned to pick up the child. A staff meeting was held on January 24, 2022 and January 26, 202, staff reviewed the policies and procedures. Staff signed stating they had read and would follow the policies. This corrective action plan has been reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. Licensing conducted a routine inspection on June 10, 2022 and determined the corrective action plan was being followed. Licensee stated there have been no other issues with staff not following the guidance policy.

A licensee must ensure that behavioural guidance is appropriate to the age and development of the child who is receiving the guidance,

Observation: Through the investigation process, Licensing determined that a staff had physically moved a child without their consent after a child refused to apologize for hurting another child in care.

Corrective action: Ensure that behavioural guidance is appropriate to the age and development of the child who is receiving the guidance. Action/s required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On January 26, 2022 the Licensee submitted a corrective action plan specific to the contravention. The corrective action plan included all staff received a copy of the facility’s Behaviour Guidance policies and procedures. A staff meeting was held on January 24, 2022 and January 26, 2022, where employees reviewed the policies and procedures. Staff signed stating they had read and would follow the policies. The Behavioural Guidance policy included that under no circumstance would Castle Care staff physically remove a child from any situation, unless the child had a care plan in place with the parent’s signed consent that the child was in need of being physically removed from a situation. This corrective action plan has been reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. Licensing conducted a routine inspection on June 10, 2022 and determined the corrective action plan was being followed. Licensee stated there have been no other issues with staff not following the guidance policy.
