Despite this section, during the half hour before a care program begins and the half hour after a care program ends, a licensee may permit children who would otherwise be grouped in different care programs, and who are arriving at or leaving the community care facility, to be grouped together and supervised other than as required under Schedule E if a total of 8 or fewer children are present at the community care facility, of whom no more than 3 are younger than 36 months old,
Observation: Through the investigation process, Licensing observed that children who would be otherwise grouped in different care programs were grouped together when arriving at the community care facility in a way that was not permitted by legislation. Specifically, during an Unscheduled Complaint Inspection conducted on February 21, 2023, Licensing observed children from the Group Child Care (30 Months to School Age) program and the Group Child Care (Under 36 Months) programs were combined on arrival to the facility for forty-five minutes. Licensing observed that the combined group had twelve children, six of which were under thirty six months and six of which were over thirty six months.
Corrective action: Ensure that during the half hour before a care program begins, children who would otherwise be grouped in different care programs be grouped together with a total of eight or fewer children with no more than three children younger than thirty six months old. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On March 9, 2023, Licensee submitted a corrective action plan to Licensing. The corrective action plan included an updated staff schedule and indicated that the grouping of children on arrival would not exceed three children under thirty six months old or the maximum capacity of eight children. This corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. Follow Up Inspection required. Unscheduled Follow Up Inspection on March 24, 2023, Licensing observed children from different care programs were grouped together on arrival to the facility for a total of thirty minutes. The group had five children and three of those children were under thirty six months of age.
Without limiting subsection (1), a licensee must ensure that the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Through the investigation process, Licensing observed that the ratio of employees to children was less than that permitted in Schedule E. Specifically, during an Unscheduled Complaint Inspection conducted on February 21, 2023, Licensing observed one Infant and Toddler Educator and two Early Childhood Educator Assistants with eight children in the Group Child Care (Under 36 Months) Toddler program and one Early Childhood Educator and two Early Childhood Educator Assistants with nine children the Group Child Care (Under 36 Months) Infant program.
Corrective action: Ensure that the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On March 9, 2023, Licensee submitted a corrective action plan to Licensing. The corrective action plan included an updated staff schedule indicating that staff scheduled for each of the Group Child Care (Under 36 Months) programs included an Infant and Toddler Educator for the first four children, an Early Childhood Educator for five to eight children and an Early Childhood Educator Assistant for nine to twelve children. This corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. Follow Up Inspection required. Unscheduled Follow Up Inspection on March 24, 2023, Licensing observed one Infant and Toddler Educator, one Early Childhood Educator and one Early Childhood Educator Assistant with ten children in the Group Child Care (Under 36 Months) Toddler program and one Infant and Toddler Educator, one Early Childhood Educator and one Early Childhood Educator Assistant with seven children the Group Child Care (Under 36 Months) Infant program.
