A licensee must ensure that behavioural guidance is appropriate to the age and development of the child who is receiving the guidance,

Observation: Through the investigation process, Licensing observed that behavioural guidance was used that was not appropriate to the age and development of the child who was receiving the guidance. Specifically, during an Unscheduled Routine Inspection conducted on February 3, 2022, Licensing observed a staff hold a child as a form of behaviour guidance.

Corrective action: Ensure that behavioural guidance is appropriate to the age and development of the child who is receiving the guidance. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On April 6, 2022 Licensee submitted a corrective action plan to Licensing. This corrective action plan included meeting with staff regarding the use of physical restraint as a form of behaviour guidance. This corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. Follow Up Inspection required. Follow Up inspection on June 29, 2022. Licensee stated that a staff meeting was held on May 2, 2022 regarding the use of restraint as a form of behaviour guidance.

A licensee must ensure that a child, while under the care or supervision of the licensee, is not subjected to confinement or physical restraint by an employee, except as authorized in a child care plan if the plan includes instructions respecting behavioural guidance.

Observation: Through the investigation process, Licensing observed that a child was subjected to physical restraint not authorized in a care plan for the child. Specifically, during an Unscheduled Routine Inspection conducted on February 3, 2022, Licensing observed a staff hold a child as a form of behaviour guidance.

Corrective action: Ensure that a child, while under the care or supervision of the Licensee is not subjected to confinement or physical restraint by an employee, except as authorized in a child care plan if the plan included instructions regarding behavioural guidance. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On April 6, 2022 Licensee submitted a corrective action plan to Licensing. This corrective action plan included meeting with staff regarding the use of physical restraint as a form of behaviour guidance and creating a care plan for a child if the require extra support. This corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. Follow Up Inspection required. Follow Up inspection on June 29, 2022.
