A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee,
Observation: Through the investigation process, Licensing determined that the medical health officer had not been notified within 24 hours after a child had been involved in a reportable incident.
Corrective action: Ensure the Medical Health Officer is notified within 24 hours if a child has been involved in a reportable incident as described in Schedule H, specifically restraint. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to this contravention. Action/s Required by Licensing: On March 2, 2022 Licensee submitted a corrective action plan to Licensing. The corrective action plan included: updating the behaviour guidance policy in the parent handbook and staff manual specific to the use of restraints and instructing managers that if an emergency restraint was used then an incident report must be filed. The corrective action plan was reviewed and accepted by Licensing.
A licensee must ensure that behavioural guidance is appropriate to the age and development of the child who is receiving the guidance,
Observation: Through the investigation process, Licensing determined that behaviour guidance used was not appropriate to the age and development of the child receiving the guidance. Specifically, that a staff restrained a child as a form of behaviour guidance not authorized in a child care plan.
Corrective action: Ensure that behaviour guidance is appropriate to the age and development of the child receiving the guidance. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to this contravention. Action/s Required by Licensing: On March 2, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included: updating the behaviour guidance policy in the parent handbook and staff manual, reviewing behaviour guidance with all managers and terminating employment of the staff. The corrective action plan was reviewed and accepted by Licensing.
A licensee must operate the community care facility in a manner that will promote the health, safety and dignity of person in care
Observation: Through the investigation process, Licensing determined that staff did not demonstrate the skills and abilities to carry out the duties as assigned. Specifically, that a staff had not used appropriate behaviour guidance with children in care.
Corrective action: Ensure the community care facility is operated in a manner that will promote the health, safety and dignity of persons in care, specifically regarding suitability of staff members. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to this contravention. Action/s Required by Licensing: On March 2, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included: updating the behaviour guidance policy in the parent handbook and staff manual, reviewing behaviour guidance with all managers and terminating employment of the staff. The corrective action plan was reviewed and accepted by Licensing.
A licensee must ensure that a child, while under the care or supervision of the licensee, is not subjected to confinement or physical restraint by an employee, except as authorized in a child care plan if the plan includes instructions respecting behavioural guidance.
Observation: Through the investigation process, Licensing determined that a child was subjected to physical restraint by an employee. Specifically, that a staff restrained a child as a form of behaviour guidance that was not authorized in a child care plan.
Corrective action: Ensure that a child while under the care or supervision of the Licensee is not subjected to confinement or physical restraint by an employee except as authorized in a child care plan if the plan includes instructions respecting behaviour guidance. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to this contravention. Action/s Required by Licensing: On March 2, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included: updating the behaviour guidance policy in the parent handbook and staff manual regarding the use of restraints, reviewing behaviour guidance with all managers and terminating employment of the staff. The corrective action plan was reviewed and accepted by Licensing.
