Contraventions: A summary of the new contraventions found during the inspections are listed below.

A licensee must ensure that meals are provided by ongoing room tray service, if by ongoing room tray service, if indicated in the care plan of a person in care,
Observation: Through the investigation process, Licensing determined that the Licensee did not ensure that if meals were provided by ongoing room tray service, that it was indicated in the care plan of a person in care.
Corrective action: Ensure that if ongoing room tray service is provided, it is indicated in the person in care's care plan. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On December 9, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included: discussion with the person in care about Residential Care Regulation (RCR) requirements about ongoing tray service, agreement by the person in care to eat two meals per day in dining room, the staff schedule was updated to allow specific instruction to support the person in care up for dinner and back to bed afterwards, the family physician of the person in care was to conduct home visit to discuss the issue further and provide support to the person in care to eat meals in the dining room. The corrective action plan was reviewed and accepted by Licensing. On August 4, 2023, Victoria Association for Community Living became the new Licensee of the facility. The substantiated contraventions occurred when the facility was licensed under the former Licensee.
A licensee must ensure that meals are provided by ongoing room tray service, if approved by the person in care’s medical practitioner or nurse practitioner
Observation: Through the investigation process, Licensing determined that meals were provided by ongoing room tray service that were not approved by the person in care's medical practitioner or nurse practitioner.
Corrective action: Ensure that a person in care's meals are provided by ongoing room tray service, approval is obtained by the person in care's medical practitioner or a nurse practitioner. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On December 9, 2022, Licensee submitted a corrective action plan to Licensing. Subject to subsection (3), if a person in care is involved in a reportable incident, the licensee must immediately notify a medical health officer, in the form and in the manner required by the medical health officer
Observation: Through the investigation process, Licensing determined that the Licensee did not immediately notify a medical health officer, in the form and in the manner required by the medical health officer if a person in care is involved in a reportable incident.
Corrective action: Ensure the medical health officer is notified in the form and in the manner required, if a person in care is involved in a reportable incident. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On December 9, 2022, Licensee submitted a corrective action plan to Licensing. The corrective action plan included: Licensing reporting requirements were included in the orientation package given to new staff to review and sign and refresher training for all staff on reporting requirements was to be offered by Licensing in January or February of 2023. The corrective action plan was reviewed and accepted by Licensing. Licensing to review and monitor this corrective action plan. On May 23 and 30, 2023, Licensing provided incident reporting education to staff. On August 4, 2023, Victoria Association for Community Living had become the new Licensee of the facility. The substantiated contraventions occurred when the facility was licensed under the former Licensee.

Observation: Through the investigation process, Licensing determined that the Licensee did not ensure that if meals are provided by ongoing room tray service, that the person in care's medical practitioner or nurse practitioner has reassessed at least once every 30 days.
Corrective action: Ensure that if meals are provided by ongoing room tray service, that the person in care's medical practitioner or nurse practitioner has reassessed at least once every 30 days. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention.
