Subject to subsection (2), a licensee may restrain a person in care if the restraint is necessary to protect the person in care or others from imminent serious physical harm

Observation: Through the investigation process, Licensing determined that a person in care had been restrained when as restraint was no necessary to protect the person in care or others from imminent serious physical harm.

Corrective action: Ensure that a licensee may restrain a person in care if the restraint is necessary to protect the person in care or others from imminent serious physical harm. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to this contravention. Action/s Required by Licensing: On February 25, 2022 the Director or Care submitted a corrective action plan which included: review Residential Care Regulation section 74 in its entirety at the next nurses and HCA monthly meetings, held March 9 and 7, 2022 respectively, and emphasize the need for written consent from both practitioner and family prior to restraint use and the use of restraints such as closing an elder's door only in the event of imminent serious harm to the elder, with meeting minutes to be provided to Licensing.
