3020 - CCALA 7(1)(b)(i) 
 

A licensee must operate the community care facility in a manner that will promote the health, safety and dignity of persons in care

Observation: Through the investigation process, Licensing determined that staff had not followed the Public Health Order and provided physical proof of immunizations against Covid-19 for one staff member who continued to work while not fully vaccinated.

Corrective action: Ensure the community care facility is operated in a manner that will promote the health, safety, and dignity of persons in care, specifically that all staff follow the Public Health Orders related to vaccination requirements. Action/s Required by Licensee: Licensee to submit a corrective action plan specific to the contravention. Action/s Required by Licensing: On April 11, 2022 Licensee submitted a corrective action plan to Licensing. The corrective action plan included a policy has been developed that requires all new hires to show proof of vaccination status. This corrective action plan was reviewed and accepted by Licensing.

Observation: Through the investigation process, Licensing determined that a staff member did not have the character and skills to carry out the duties assigned.

Corrective action: Ensure that a community care facility is operated in a manner that will promote the health, safety, and dignity of persons in care. Specifically that Enoch Chowdhury, RN has the character and skills to carry out the duties assigned. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On April 11, 2022 the Licensee submitted a corrective action plan to Licensing. This corrective action plan stated that Enoch Chowdhury, RN will be required to show physical proof of vaccination status before returning to work. Upon his return, Licensee will consider disciplinary actions. This corrective action plan was reviewed and accepted by Licensing. On May 26, 2022, Licensing received a copy of Twin Oaks policy regarding hiring requirements stating that proof of vaccination for COVID-19 was required.

Action/s Required by Licensing: On April 11, 2022, Licensee submitted a corrective action plan to Licensing. This corrective action plan included that the staff was required to show physical proof of vaccination status before returning to work and if the staff returned, the Licensee would consider disciplinary actions. This corrective action plan was reviewed and accepted by Licensing. On May 26, 2022, Licensing received a copy of the facility policy regarding hiring requirements which stated that proof of vaccination for COVID-19 was required.

Observation: Through the investigation process, Licensing determined that a staff had not followed the Public Health Order regarding proof of mandatory vaccinations and the staff continued to work while not fully vaccinated.

Corrective action: Ensure the community care facility is operated in a manner that will promote the health, safety, and dignity of persons in care. Specifically that all staff follow Public Health Orders. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On April 11, 2022, Licensee submitted a corrective action plan to Licensing.
