A licensee must ensure that a person in care is not, while under the care or supervision of the licensee subjected to any of the following types of abuse or neglect, as described in section 1 of Schedule D: neglect
Observation: Through the investigation process, Licensing determined that a person in care was subjected to neglect.
Corrective action: Ensure that a person in care is not, while under the care or supervision of the licensee, subjected to neglect. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On January 18, 2024, the Administrator submitted a corrective action plan to Licensing. The corrective action plan included: the incident would be reviewed with staff for educational purposes, and huddles would be held regularly with staff regarding safety checks on persons in care, and the expectation of safety checks during shifts. This corrective action plan was reviewed and accepted by Licensing. As a result of a Summary Action Memo dated September 15, 2023 prepared by Licensing and the Medical Health Officer's recommendation to Island Health's Board of Directors, the Board of Directors appointed an Administrator to Victoria Chinatown Care Centre for a term of six months, September 20, 2023 to March 31, 2024. Licensing will continue to work with the Licensee and the Administrator and monitor the facility's compliance with the Community Care and Assisted Living Act and the Residential Care Regulation. Licensing will continue to follow up on the areas identified in the Summary Action Memo through the Routine Inspection Process.
Subject to subsection (2), a licensee may restrain a person in care if there is agreement to the use of a restraint given in writing by both the person in care, the parent or representative of the person in care or the relative who is closest to and actively involved in the life of the person in care,
Observation: Through the investigation process, Licensing determined that there was no restraint agreement in writing for a person in care signed by a representative.
Corrective action: Ensure that a person in care is not restrained without a written agreement to the use of a restraint by both the person in care, the parent or representative of the person in care or the relative who is closest to and actively involved in the life of the person in care. Action/s Required by Licensee: Licensee to submit a corrective action plan to Licensing specific to the contravention. Action/s Required by Licensing: On January 18, 2024, the Administrator submitted a corrective action plan to Licensing. The corrective action plan included: a restraint agreement was created for the person in care and was signed by a representative. This corrective action plan was reviewed and accepted by Licensing. On December 13, 2023 Licensing received a copy of the signed restraint agreement. As a result of a Summary Action Memo dated September 15, 2023 prepared by Licensing and the Medical Health Officer's recommendation to Island Health's Board of Directors, the Board of Directors appointed an Administrator to Victoria Chinatown Care Centre for a term of six months, September 20, 2023 to March 31, 2024. If a person in care becomes ill or is injured while under the care or supervision of a licensee, the licensee must immediately notify the parent or representative, or contact person, of the person in care
Observation: Through the investigation process, Licensing determined that the representative for a person in care was not immediately notified when a person in care became ill or was injured.
