12VAC5-421-3910. Imminent Health Hazard, Ceasing Operations and
Reporting.
A. Except as specified in subsection B of this section, a permit holder shall immediately
discontinue operations and notify the regulatory authority if an imminent health hazard may
exist because of an emergency such as a fire, flood, extended interruption of electrical or
water service, sewage backup, misuse of poisonous or toxic materials, onset of an apparent
foodborne illness outbreak, gross insanitary occurrence or condition, or other circumstance
that may endanger public health.
An imminent health hazard exists in this facility due to large structural fire.
The facility suffered am external structural fire located at the electrical boxes in the rear of the facility. This caused the fire to spread from the outside onto a wooden deck structure. This then spread into the roof of the facility creating more structure damage over top of the primary kitchen facility.
The electrial power to this facility has been damaged and unable to be turn on due to the fire. No power to the facility has caused all food items in the coolers to be out of temperature and must be discarded to include: All meat items, cooked/cut or commutued vegetables, all stored sauces, and other food items stored in the facility. The food item list includes damage to packaged food items damaged by smoke, extinguishing agent, and other chemicals.
The back of the kitchen unit has a large hole in the roof that spills into the rafters and opening into the drop ceiling exposing the kitchen to the outside.
Until all structural issues have been repaired that affect the kitchen and electrial power has been restored the facility is not permitted to operate.
The owners were present and they were informed of this decision and they agreed to voluntarily close. The permit will be placed on a voluntarily closure status until all repairs are completed that affect safe cooking operations. The facility will contact VDH and thier assigned Environmental health specialist before reopening to approve the kitchen for operation.
The facility will need to be completely cleaned, all unecessary items removed and broken equipment removed and any other items damaged by the fire, smoke or chemical. The facility will be rechecked before opening.
