12VAC5-421-3910. Imminent Health Hazard, Ceasing Operations and
Reporting.
A. Except as specified in subsection B of this section, a permit holder shall immediately
discontinue operations and notify the regulatory authority if an imminent health hazard may
exist because of an emergency such as a fire, flood, extended interruption of electrical or
water service, sewage backup, misuse of poisonous or toxic materials, onset of an apparent
foodborne illness outbreak, gross insanitary occurrence or condition, or other circumstance
that may endanger public health.
An imminent health hazard exists in this facility due to large structural fire.
The facility suffered am external structural fire located at the electrical boxes in the rear of the facility. This caused the fire to spread from the outside onto a wooden deck structure. This then spread into the roof of the facility creating more structure damage over top of the facility.
The rear kitchen of the west side deli back door was damaged from the fire and entry into the building. The back storage area and deck is damaged from fire, smoke and chemical residues. These items from the outside walk-in wall, by the deck, into the dry storage area and into the main cooking line will need to be cleaned. All damaged food items, single service items and any other service item exposed to smoke, water, fire, or other sources of contaminates will need to be discarded. The area will be cleaned and all regulatory requirements that govern the food service operation will need to be corrected and repaired before reopening.
The rear most seating area of the dining area has been structurally damaged due to fire at the deck. The fire deperatment was forced to cut a whole into the roof and into the drop ceiling to create a vent and determine depth of damage. This area will need to be repaired and sealed off from public access with an impermeable weather barrier and prevent pests or rodents from entering the facility. All outer openings must be protected.
The gas lines have been turned off and capped until service provider has checked the tanks for safe operation. The electrial system may suffer future damage, or interruptiong from the fire or during the repair. If the power is removed from the facility and cold holding equipment fails then all food items will need to be discarded.
In this event it is highly recommended that the facility contact EHS to inform them of this issue and the corrective action.
The facility owner has agreed to voluntarily close until repairs have been made, cleaning is performed, and fire marshall has approved reopening. The gas line, electrical system and all measures noted with the owner will need be corrected before reopening.
